Through its applications and websites, DiDi and its affiliates provide the technology service of making available to the users a technology platform that allows them, based on the mobility needs of the Passenger (as defined below), to organize and plan mobility and logistics services, online with independent third-party taxi drivers who are the providers of such services (the "Services") and are affiliated or associated to taxi operating companies as may be required by applicable law. As mere technology provider, DiDi has no relation with the taxi service being provided by the taxi driver and/or the taxi operating company.

Taxi Driver Partners are the users who are accessing, browsing or using DiDi Driver - Taxi and relevant websites (hereinafter referred to as “Taxi Driver Partner”) and that supply the mobility and logistics services to the Passengers as independent third parties.

The users who are accessing, browsing or using DiDi Fleet - Taxi hereinafter shall be referred to as the “Non-driving Taxi Partners”.

Passengers who are accessing, browsing or using DiDi Passenger - Taxi hereinafter shall be referred to as the “Passenger”.

This Privacy Policy of DiDi Driver - Taxi (hereinafter referred to as this “Privacy Policy”or the “Privacy Policy” both synonyms), together with the Terms and Conditions of Use of DiDi Driver - Taxi, sets out the basis on which the collected Taxi Driver Partner’s Personal Information will be processed.

DiDi Driver - Taxi is owned and operated by DiDi, and DiDi may obtain, disclose, use, process, store, transmit and transfer the Taxi Driver Partner’s Personal Information and will process and treat the Taxi Driver Partner’s Personal Information in accordance with this Privacy Policy and the Law.

Before providing any Personal Information, the Taxi Driver Partner shall be informed of the purposes for which such data shall be handled.

Likewise, the Taxi Driver Partner understands and accepts that the Personal Information provided at the time of registration on the DiDi Driver – Taxi app has been used to reach this point in the registration process and will also be processed and treated under this Privacy Policy and applicable laws.

DiDi does not process or will not process Personal Information corresponding to Taxi Driver Partners, Non-driving Taxi Partners and Passengers who are minors, in accordance with applicable laws.

2.1DiDi may collect the Personal Information, including but not limited to:

The Taxi Driver Partner may need to provide his/her name, mobile phone number, ID card and other relevant Personal Information on DiDi Driver - Taxi in order to register in the Platform. DiDi will recognize the Taxi Driver Partner’s identity and provide the Taxi Driver Partner with services on DiDi Driver - Taxi. As required, the Taxi Driver Partner needs to provide vehicle brand, model and color, vehicle registration certificate, and vehicle official documentation.

DiDi collects such information by laws and regulations for personal and property safety of the Taxi Driver Partner and the Passenger. If the Taxi Driver Partner does not provide such information, the Taxi Driver Partner may fail to fully access the Services of DiDi Driver - Taxi.

DiDi will collect the Taxi Driver Partner’s location information when DiDi Driver - Taxi is running in the foreground (the application is open and on screen) or background (the application is open but not on screen) of the Taxi Driver Partner’s device. DiDi will obtain the Taxi Driver Partner’s location through IP address, GPS, and other sensors that provide relevant information (such as providing DiDi with nearby devices, Wi-Fi access points, and base station information) for better providing the Services.

Determining the location of the Taxi Driver Partner will allow us to fully implement the functionality of our service, in particular, to more effectively respond to situations that may require our participation, including those related to ensuring his/her safety. The Taxi Driver Partner can revoke his/her consent for us to receive his/her location information at any time by deactivating the location function in your settings in his/her device.

DiDi will collect the Taxi Driver Partner’s place of departure and destination, route, duration and mileage information. DiDi collects the aforesaid information based on the requirements of laws and regulations, protection of the Taxi Driver Partner’s personal and property safety, as well as the need for dealing with disputes of the Taxi Driver Partner in accordance with the rules of DiDi Driver - Taxi.

DiDi may record and collect the content of the calls and the messages that the Taxi Driver Partner makes through DiDi Driver - Taxi with the Passenger, representatives of DiDi or other persons in relation to the Services, including but not limited to the duration of the call, the mobile phone number of the communicated parties. DiDi keeps the aforesaid information through call recording, so as to verify the facts and handle complaints in case of disputes or safety accidents of the Taxi Driver Partner, these calls therefore, would not be considered as private, an thus the Taxi Driver Partner (nor the Passenger) cannot consider these calls as private spaces.

DiDi may record the Taxi Driver Partner’s orders and transactions status. DiDi collects such information by laws and regulations for the Taxi Driver Partner’s personal and property safety, and evidence for disputes.

The Taxi Driver Partner can evaluate the Passenger anonymously on DiDi Driver - Taxi. For such purposes, the Taxi Driver Partner shall not include any Taxi Driver Partner’s Personal Information during the process. Otherwise, such information may be disclosed to the Passenger. DiDi shall not require that the Taxi Driver Partner provides any Personal Information in order to perform the rating.

DiDi may collect the Taxi Driver Partner’s Financial Data to collect from and distribute money to the Taxi Driver Partner’s appointed account, and for other purposes related to the aforesaid payment facilitation while providing the Services

DiDi may collect a certificate of no criminal conviction (issued by the competent authorities) from the Taxi Driver Partner, to make sure the Taxi Driver Partner satisfied the mandatory need to operate on DiDi Driver - Taxi. The uploading of the certificate of no criminal conviction will be deemed that the Taxi Driver Partner authorizes DiDi and DiDi Driver - Taxi to collect, transfer, transmit, store and use such certificate in accordance with this Privacy Policy. If the Taxi Driver Partner provides its photography or any facial recognition characteristics, where DiDi processes such sensitive personal information, DiDi will usually do so on the basis that it is necessary for reasons of carrying out obligations in the field of fraud prevention or public security related law or to establish, exercise or defend any legal claims. In any case, the Company will process this data in accordance with applicable laws.

When the Taxi Driver Partner contact the customer service team, DiDi will record the Taxi Driver Partner’s call information, the Taxi Driver Partner’s comments or suggestions, the name and contact information and other information provided by the Taxi Driver Partner through call recording and manual input manner, so that DiDi may, in its sole discretion, to facilitate the disputes resolution, solve the problems or give the Taxi Driver Partner feedback. If the Taxi Driver Partner refuses DiDi to collect such information, it will result in that DiDi’s customer service team may not able to handle and solve the disputes, but it would not affect the Taxi Driver Partner’s use of the core business functions of DiDi Driver - Taxi, this shall not prevent the Taxi Driver Partner’s rights as a user of the DiDi Driver - Taxi, these calls therefore, would not be considered as private, an thus the Taxi Driver Partner cannot consider these calls as private spaces.

In order to better improve the Services of DiDi Driver - Taxi, DiDi will collect the Taxi Driver Partner’s logging information, the search content, IP address, device (including device model, device identification code, operating system, and telecommunications operator), location, thus providing the Taxi Driver Partner with more personalized and convenient services. DiDi will use the browser storage mechanism and data cache to collect and store information on the Taxi Driver Partner’s device. DiDi may obtain the Taxi Driver Partner’s consent to collect and use such data when DiDi is required to do so by law. If DiDi asks for the Taxi Driver Partner’s consent to process such data, the Taxi Driver Partner may withdraw his/her consent at any time by contacting DiDi.

During the course of the Taxi Driver Partner’s use of the third-party services, DiDi will collect (including the information provided by the Taxi Driver Partner and the information recorded by the system) the Taxi Driver Partner’s necessary Personal Information and share it with the third party providing such services, including DiDi’s service providers and business partners that perform business operations for DiDi, so that the third party can provide the Taxi Driver Partner with appropriate services. If the Taxi Driver Partner refuses collection of such information, the Taxi Driver Partner may not be able to use the third-party services through DiDi Driver - Taxi, but it would not affect the Taxi Driver Partner’s use of the core business functions of DiDi Driver - Taxi.

2.8 Software Development Kit ("SDK")

The following information is collected by DiDi through the SDK:

- Location information for Google and Waze related logging and / or mapping functions.

- Device identification information for the marketing analysis functions and / or advertising statistics related to AppsFlyer.

DiDi Driver - Taxi may request some of the Taxi Driver Partner’s device permissions. The Taxi Driver Partner is deemed to grant device permission of Internet accessing when he/she accesses or uses DiDi Driver - Taxi.

The Taxi Driver Partner may choose to close some or all of the permissions in the device, so as to prevent DiDi from collecting the corresponding Personal Information. For different devices, the permissions display manner and closing manner may be different, please contact the device and system developers for details.

4.1.1DiDi will keep the Taxi Driver Partner's Personal Information continuously while he/she has an account at DiDi Driver - Taxi and for a reasonable period of time afterwards as long as such retention is necessary for DiDi to 1) provide the Services to the Taxi Driver Partner, 2) comply with record retention requirements under the law, 3) maintain business records for reporting, analysis and/or audit purposes, 4) defend or bring any existing or potential legal claims, and 5) deal with any complaints regarding the Services.

4.1.2Taxi Driver Partner's Personal Information will be deleted, upon request within a maximum period of 2 (two) business days, according to the applicable law

4.1.3The Taxi Driver Partner may cancel the account on DiDi Driver - Taxi via in-app function or by contacting customer service. DiDi Driver - Taxi will preserve the Taxi Driver Partner’s Personal Information for personal and property safety of the Taxi Driver Partner, unless the Taxi Driver Partner expressly requests DiDi not to do so, or applicable laws and regulations stipulate otherwise.

4.1.4If the Taxi Driver Partner wants to delete his/her Personal Information, he/she may contact the customer service to submit the deletion application. DiDi will delete his/her Personal Information within a business reasonable amount of time, unless further retention is permitted or required by applicable laws and regulations.

The Taxi Driver Partner’s Personal Information collected by DiDi will be transferred and stored in U.S. ,China or any other adequate places as appropriate and in accordance with applicable laws and regulations, which are controlled by DiDi and its affiliates. When transmitting information to third parties, such information may only be used for the purposes described herein.

5.1The Taxi Driver Partner fully acknowledges and agrees that the Taxi Driver Partner’s Personal Information will be used in the usage scenarios which are clearly stated in the clause “Collection of the Personal Information”.

5.2 The Taxi Driver Partner fully acknowledges and agrees that the Taxi Driver Partner’s Personal Information may be used in the usage scenarios which are directly or reasonably related to the purposes stated in the clause “Collection of the Personal Information”:

5.2.1 The Taxi Driver Partner fully acknowledges and agrees that DiDi or any of its related companies (meaning those that belong to the same business group), subsidiaries and/or affiliates may analyze Personal Information to provide the Taxi Driver Partner with a more personalized and convenient service.

5.2.2 The Taxi Driver Partner fully acknowledges and agrees that DiDi or any of its related companies (meaning those that belong to the same business group), subsidiaries and/or affiliates may design, develop and promote new products and services available for Taxi Driver Partner’s use based on Taxi Driver Partner's Personal Information statistics.

5.2.3 The Taxi Driver Partner fully acknowledges and agrees that DiDi may analyze the Taxi Driver Partner's anonymized Personal Information and share such anonymized statistics with the public or the third party for the purpose of providing the Services.

5.2.4 The Taxi Driver Partner fully acknowledges and agrees that DiDi will send the Taxi Driver Partner information and notifications through various channels, including but not limited to the verification code, the necessary pushed notifications when using the products or services, the news about the services of DiDi Driver - Taxi, as well as marketing activities and special promotion information, and the promotional information of DiDi, any of its related companies (meaning those that belong to the same business group) or third parties in cooperation with DiDi Driver - Taxi, or other content that the Taxi Driver Partner may be interested in, if there is a previous authorization by the Taxi Driver Partner, in accordance with the information provided by the Taxi Driver Partner. If the Taxi Driver Partner does not wish to continue receiving the aforesaid information, the Taxi Driver Partner may unsubscribe it and/or cancel DiDi´s notifications on his/her device.

5.3In case DiDi uses the Taxi Driver Partner’s Personal Information beyond the scope which is directly or reasonably related to the purposes stated in this Privacy Policy, DiDi will further inform the Taxi Driver Partner and obtain the Taxi Driver Partner’s consent.

6.1The Taxi Driver Partner fully acknowledges and agrees that DiDi will keep the Taxi Driver Partner’s Personal Information confidential in accordance with relevant laws and regulations. DiDi will not share the Taxi Driver Partner’s Personal Information with other people except the following situations:

6.1.1The Taxi Driver Partner fully acknowledges and agrees that DiDi may share the Taxi Driver Partner’s Personal Information for the pursuit of commercial legit purposes of administrative and internal reporting to DiDi’s affiliates and subsidiaries, in each case, that disclosure is made under terms of confidentiality no less restrictive than those set out in this Privacy Policy.

6.1.2The Taxi Driver Partner fully acknowledges and agrees that DiDi may share the Taxi Driver Partner’s Personal Information to DiDi’s service providers and business partners that perform business operations for DiDi to provide the Services through DiDi Driver - Taxi to the Taxi Driver Partner. For example, DiDi may share information with the corresponding Non-driving Taxi Partner or the Passengers appointed by DiDi Driver - Taxi, which may include the Taxi Driver Partner’s name, telephone number, and other Personal Information as required by DiDi Driver - Taxi.

6.1.3The Taxi Driver Partner fully acknowledges and agrees that DiDi provides reciprocal services with other cooperative third-party service providers, such as DiDi’s service providers and business partners (hereinafter referred to as the “Cooperative 3rd Parties”). In order to improve the quality of services provided by DiDi, DiDi may share the Taxi Driver Partner’s Personal Information with the affiliated company and Cooperative 3rd Parties, provided that disclosure is made under terms of confidentiality no less restrictive than those set out in this Privacy Policy.

6.1.4The Taxi Driver Partner fully acknowledges and agrees that DiDi may transfer or transmit the Taxi Driver Partner’s Personal Information to vendors, service providers, and other partners who globally support DiDi’s business, such as providing technical infrastructure services, providing investigation services regarding criminal background check, analyzing how DiDi’s services are used, measuring the effectiveness of services, providing customer service, or facilitating and processing payments. These partners must adhere to strict confidentiality obligations in a way that is consistent with this Privacy Policy and the agreements DiDi enters into with them. In the cases mentioned herein, Personal Information may only be used for the purposes established in this document.

6.1.5When the Taxi Driver Partner uses the third-party services through DiDi Driver - Taxi, the Taxi Driver Partner fully acknowledges and agrees that DiDi will share the Taxi Driver Partner’s Personal Information with the third party who provides the services, the third party shall only use the information for the purposes described herein.

6.1.6In order to protect the legitimate rights and interests of the Taxi Driver Partner, the Taxi Driver Partner fully acknowledges and agrees that DiDi may provide the interested parties (including any law enforcement agency, court, regulator or government authority) with the information necessary to resolve any transaction dispute where DiDi believes this is necessary to comply with a legal or regulatory obligation, or otherwise to protect DiDi’s rights or the rights of other third party.

6.1.7The Taxi Driver Partner fully acknowledges and agrees that DiDi or any of its related companies may transfer or transmit the Taxi Driver Partner’s Personal Information to administrative or judicial authority according to applicable laws or regulations.

6.1.8To the extent permitted or required by the applicable laws and regulations, DiDi may disclose the Driver Partner’s Personal Information necessary to protect the public interest. Upon agreeing to this Privacy Policy, the Driver Partner acknowledges and agrees that DiDi or any of DiDi’s related companies may transfer the Driver Partner’s Personal Data to any authorities and public investigation entities, as specified in the “Purposes for the Processing of Personal Information” section above, with the purpose of agreeing upon strategies that will allow for the successful analysis, investigation and criminal prosecution of various criminal phenomena associated with mobile apps that provide similar services to DiDi’s Services. This authorization comprehends DiDi’s ability to share information with the relevant authorities when, in the opinion of DiDi, it may contribute to the public interest. The Personal Information expressly authorized to be transferred to such public entities include the date of registration and the date of the most recent trip, name, mobile number, e-mail address, bank account information, only regarding the bank name and type of bank product, copy of the driver’s license and government-issued ID (a card or similar), vehicle related information and profile photo, as well as any location data and trip data (including the Driver Partner’s start point, trip start point, requested trip endpoint, actual trip endpoint, route map, date and time), among others.

6.1.9DiDi may share the Taxi Driver Partner’s Personal Information as established in section 4.2 of this Privacy Policy.

6.1.10Other situations that are permitted by the Taxi Driver Partner.

6.2DiDi will not provide the Taxi Driver Partner’s Personal Information to any third party that is not stipulated in this Privacy Policy, unless DiDi obtains the Taxi Driver Partner’s previous and express consent. DiDi will enter into a strict confidentiality agreement with the third party with whom DiDi shares the Taxi Driver Partner’s Personal Information, requesting them take necessary confidential and security measures to process the Taxi Driver Partner’s Personal Information.

6.3DiDi will keep the Taxi Driver Partner’s Personal Information safe and confidential in accordance with relevant laws and regulations. DiDi will not publicly disclose the Taxi Driver Partner’s Personal Information unless the Taxi Driver Partner has given his/her explicit consent or authority in advance, or as required by laws and regulations.

6.4In the event of acquisition, merger, reorganization and other changes, DiDi will require its successor to comply with this Privacy Policy. If the successor needs to change the purpose of usage of the Personal Information, the successor shall obtain the Taxi Driver Partner’s explicit consent in advance.

Taxi Driver Partner shall have the rights established in the applicable regulation, and especially may exercise its rights through DiDi Platform, as follows:

The Taxi Driver Partner may access Personal Information on DiDi Driver - Taxi in the following ways:

The Taxi Driver Partner may access the Taxi Driver Partner’s Personal Information and other information provided by the Taxi Driver Partner through the Taxi Driver Partner’s account on DiDi Driver - Taxi.

The Taxi Driver Partner may access the trip, order and transaction status on DiDi Driver - Taxi.

The Taxi Driver Partner may access the payment method, payment record and other information through the wallet feature of DiDi Driver - Taxi.

8.1.4In case the Taxi Driver Partner requires to access, edit or modify any additional information or to exercise his/her rights as data subject, the Taxi Driver Partner may contact DiDi’s customer service team at any time.

The Taxi Driver Partner has the right to make corrections or updates of the Personal Information. The Taxi Driver Partner may correct or modify his/her Personal Information on DiDi Driver - Taxi by submitting his/her correction application to the customer service team or by the following manners:

The Taxi Driver Partner may correct or modify the Taxi Driver’s Personal Information through the Taxi Driver Partner’s account on DiDi Driver - Taxi.

The Taxi Driver Partner may correct or modify the password and other information through the setup feature of DiDi Driver - Taxi.

The Taxi Driver Partner may correct or modify the Financial Data and other information through the wallet feature of DiDi Driver - Taxi.

8.2.4In case the Taxi Driver Partner requires to report or modify any additional information, Taxi Driver Partner may contact DiDi’s customer service team at any time.

8.3.1DiDi will protect the Taxi Driver Partner’s right to withdraw the Taxi Driver Partner’s consent in the following ways:

a.The commercial information sent by DiDi Driver - Taxi will tell the Taxi Driver Partner the specific unsubscribing manner, and the Taxi Driver Partner may withdraw the Taxi Driver Partner’s consent through the unsubscribing manner described in the commercial information.

b.The Taxi Driver Partner may withdraw the Taxi Driver Partner’s authorization to access the Taxi Driver Partner’s Personal Information and Personal Sensitive Data to DiDi through the device's setup feature to close the corresponding device permissions (including location, address book, photo, microphone, camera, notification, etc.).

c.The Taxi Driver Partner may also withdraw part of the authorization by cancelling bank card binding, deleting information, etc.

8.3.2When the Taxi Driver Partner withdraws his/her consent or authorization, DiDi may/will not be able to continue to provide the Taxi Driver Partner with the services corresponding to the withdrawn authorization. However, the Taxi Driver Partner’s withdrawal of consent or authorization does not have retrospective effect on the processing of Personal Information based on his/her consent prior to the withdrawal.

If the Taxi Driver Partner is unable to access, rectify, cancel or delete his/her Personal Information or withdraw the Taxi Driver Partner’s consent, the Taxi Driver Partner may contact the customer service team online or by phone through the "customer service" feature published in the DiDi Driver - Taxi contact page.

DiDi will respond to the requests made by the Taxi Driver Partners to exercise his/her rights according to the following criteria, as specified by the applicable law:

- Request for data rectification: 2 (two) business days from receipt of the request.

- Request from the user to take knowledge of the Data to her / him: 2 (two) business days of receipt of the request.

- Data update request: 2 (two) business days from receipt of the request.

- Request for deletion of Data: 2 (two) business days from receipt of the request.

9.1In case of the following changes of DiDi Driver - Taxi, DiDi will timely make the corresponding amendments to this Privacy Policy:

a.Changes of the business functions of DiDi Driver - Taxi.

b.Changes of the Taxi Driver Partner’s Personal Information usage rules.

c.Changes of DiDi’s contact information and complaint channels.

d.Other changes which may affect the Taxi Driver Partner's Personal Information security or the Taxi Driver Partner 's privacy rights.

9.2DiDi will not reduce the Taxi Driver Partner’s rights under this Privacy Policy without the Taxi Driver Partner’s explicit consent.

9.3If any amendments are to be performed to the Privacy Policy for the purposes of handling personal information, such changes will be informed to the Taxi Driver Partner before performing the changes, and the Taxi Driver Partner may decide to withdraw its authorization to handle the Personal Information.

9.4Unless otherwise specified, the revised Privacy Policy will take effect from the date of publication.

10.Definition and Scope of the Personal Information

10.1Personal Information refers to the data that can identify the personal identity of a natural person, alone or together (hereinafter referred to as “Personal Information”), if applicable, herein involves, but not limited to name, mobile phone number, a set of copy of ID card or other identity certificate, photograph, vehicle registration, vehicle model and color, insurance policy of car, mandatory insurance, location, cash withdrawal record, bank card number, logging information, search content, device information, telecommunication operator and IP address.

10.2Personal Sensitive Data refers to the Personal Information that affects the most private (intimate) information of the data owner, or which if improperly used could lead to discrimination and could entail a grave risk for the data owner (hereinafter referred to as “Personal Sensitive Data”). It herein involves, among others, criminal record and certificate of no criminal record. If required by applicable Laws, DiDi may ask written express consent from Personal Sensitive Data owner.

10.3Financial Data refers to credit or debit card information or any other payment method information, bank accounts, invoice records, payments records, payment receipts and tax information, that might be relevant for DiDi to provide the Services (hereinafter referred to as the “Financial Data”, and together with the “Personal Information” and the “Personal Sensitive Data”, referred to as the “Personal Information”).

10.4If the Taxi Driver Partner does not provide any of the Personal Information as required, they may fail to access all or part of the Services.
