This application is hereinafter referred to as "DiDi Food - Delivery Partner".

Through the "DiDi Food -Usuario Delivery Partner" application, DiDi and its affiliates offer mobile applications and related services that allow, on the one hand, Users to organize and schedule food and beverage delivery services offered by suppliers, commercial establishments and restaurants (hereinafter, the "Orders") and, on the other hand, independent delivery service providers and/or restaurants (hereinafter, the "Delivery Partners") to organize and schedule delivery services to Users through the use of the "DiDi Food - Delivery Partner" application, on the other hand, independent delivery service providers and/or restaurants when making their own deliveries (the "Delivery Partners"), organize and schedule the delivery services of said Orders to Users, through the use of DiDi and DiDi Food's Internet pages (hereinafter, the "Services"). The User who accesses, browses or uses DiDi Food and the relevant DiDi websites for the purpose of placing Orders and using the delivery services provided by the Delivery Partners is hereinafter referred to as the "User".

This DiDi Food - Delivery Partner Privacy Notice (the "Privacy Notice"), together with the DiDi Food - Delivery Partner Terms and Conditions of Use, sets forth the relevant terms and conditions regarding the treatment of Personal Information (as such term is defined below) of the Delivery Partner.

Please read this Privacy Notice carefully before using DiDi Food - Delivery Partner to understand the considerations and practices regarding the Delivery Partner's Personal Information and the treatment that will be given to such information.

If the Delivery Partner does not agree with any aspect of this Privacy Notice, it must immediately stop using DiDi Food - Delivery Partner. By clicking on the "I Accept" button and/or by using the DiDi Food - Delivery Partner application, the Delivery Partner accepts the Privacy Notice and therefore authorizes in advance, expressly and informedly, mentethe processing of his/her Personal Information in the terms described herein, including the possibility for DiDi to collect, disclose, store, use, treat, share, transmit, transfer and protect the Delivery Partner's Personal Information in accordance with the terms of this Privacy Notice.

1. Processing of Personal Information

Personal Data" shall mean any information that identifies a natural person and that the natural person uses to identify him/herself (individually or in conjunction with other information). For purposes of this Privacy Notice it includes, among other information, name, cell phone number, photograph, address, location, access information, search content, device information, telecommunications operator and IP address.

Financial Data" shall mean information on debit or credit cards or any other payment method, bank accounts, invoices, any payment media, and tax or fiscal identification information that may be relevant to DiDi for use by the DiDi Food Delivery Partner - Delivery Partner and the Orders.

Sensitive Personal Data" shall mean information that affects the most private or intimate sphere of its owner, or whose improper use could give rise to discrimination and imply a serious risk to the owner. In this Privacy Notice, such data includes, among others, the Criminal Record Certificate and the information of the Delivery Partner for purposes of facial recognition functionalities. If required by applicable laws, DiDi may request the express consent of the holder of the Sensitive Personal Data.

Personal Data, together with Financial Data and Sensitive Data shall be referred to, for purposes of this document, as "Personal Information".

DiDi owns and operates DiDi Food - Delivery Partner, and therefore, DiDi may collect, disclose, store, use, process, share, transmit, transfer and protect the Delivery Partner's Personal Information in accordance with this Privacy Notice and applicable law.

Prior to providing any Personal Information, the Delivery Partner shall know and accept the purposes of the processing for the use of DiDi Food - Delivery Partner.

If the Delivery Partner does not provide the requested Personal Information, it may lose access to all or part of DiDi Food - Delivery Partner.

2. Purposes of the Processing of Personal Information

2.1 DiDi may process, among others, the following Personal Information:

DiDi may process the information of the Delivery Partner for the purpose of making calls, or sending SMS or other types of messages through automated systems, for purposes such as support in the completion of the registration process (if required), marketing activities, loyalty or other similar activities.

2.1.2 Other Delivery Partner Information

In the event that the Delivery Partner provides its photograph and facial recognition features, DiDi will process such Sensitive Personal Data in order to comply with fraud prevention or security obligations, or public safety laws, or to exercise any legal action or defend against a claim, or to comply with the requirement of authorities or other purpose that is previously informed to the Delivery Partners.

In any case, DiDi will only process sensitive data voluntarily provided by the Delivery Partner, in compliance with the applicable legislation.

2.1.3 Location

For the use of DiDi Food - Delivery Partner by the Delivery Partner, DiDi will process the Delivery Partner's location information when DiDi Food - Delivery Partner is running in the foreground (application open and on screen) or in the background (application open, but not on screen) on the Delivery Partner's device. DiDi will obtain the Delivery Partner's location through IP address, GPS and other sensors that provide relevant information (such as information about nearby devices, Wi-Fi hotspots and base station information).

2.1.4 Order

DiDi will process information about the starting and destination locations of the User's Order in charge of the Delivery Partner, the route, the distance traveled and the duration of the Order. DiDi will process the aforementioned information in accordance with applicable laws and regulations, for the protection of the Delivery Partner's personal and property, as well as to resolve disputes in accordance with DiDi Food - Delivery Partner rules.

2.1.5 Call Information

DiDi may record and process the content of calls and messages made or sent by the Delivery Partner through DiDi Food - Delivery Partner with Users, DiDi representatives or other persons in connection with DiDi Orders and DiDi Services, including without limitation, the duration of the call, the telephone numbers of the communicating parties. DiDi will retain such information to verify facts and address complaints in the event of disputes or accidents involving the Delivery Partner, all within the limits of applicable law.

2.1.6 Status of orders and transactions

DiDi may record the status of the Delivery Partner's orders and transactions in DiDi Food - Delivery Partner. DiDi will treat such information in accordance with applicable laws and regulations for the personal and property security of its users and for evidence in case of disputes.

2.2. Evaluation Information

To the extent applicable, the Delivery Partner may evaluate the User anonymously on Didi Food - Delivery Partner and for this purpose, the Delivery Partner shall not provide Personal Information. Otherwise, Personal iInformation voluntarily provided for these purposes may be disclosed to the User.

2.3 Financial Data

DiDi may receive and store the Delivery Partner's Financial Data in order to collect and transfer money to the Delivery Partner's designated account on the terms indicated in the DiDi Food - Delivery Partner Terms and Conditions of Use, and for any other effect related to the facilitation of payments during Orders.

2.4 Criminal Record Certificate

DiDi may request a Criminal Record Certificate (issued by the competent authorities) from the Delivery Partner, to ensure that the Delivery Partner meets the requirements to operate DiDi Food - Delivery Partner. The inclusion of the Criminal Record Certificate on the DiDi Food - Delivery Partner platform will be considered as the authorization granted by the Delivery Partner to DiDi to collect, transmit, transfer, store and use such certificate in accordance with this Privacy Notice.

DiDi, or as applicable its affiliated companies, will not transmit or transfer the Criminal Record Certificate to any third party, unless required by administrative or judicial authorities, in accordance with this Privacy Notice.

2.5 Customer Service

When the Delivery Partner contacts the customer service team, DiDi will record the Delivery Partner's call information, comments or suggestions, name, contact information and any other information provided by the Delivery Partner by recording calls or messages, or in the form of a manual record, so that DiDi can , a su entera discreción, facilitate dispute resolution, comment or suggestion resolution or provide feedback to the Delivery Partner. If the Delivery Partner refuses to allow DiDi to collect such information, this may result in DiDi's customer service team being unable to deal with its requests but will not affect the Delivery Partner's use of DiDi Food - Delivery Partner's core business functions and will not prevent the Delivery Partner from exercising its rights as a user of DiDi Food - Delivery Partner.

2.6 Data Analysis

To enhance the DiDi Food - Delivery Partner Services and provide Delivery Partner with more personalized and convenient ones, DiDi will collect Delivery Partner's login information, search content, IP address, device information (including model, identification code, operating system and telecommunications carrier), and location. DiDi will use a browser storage and caching mechanism to process information on the Delivery Partner's device. DiDi may obtain the Delivery Partner's consent to process this information when DiDi is required to do so in accordance with applicable regulations. In the event that DiDi requests the Delivery Partner's consent to process this information, the Delivery Partner may withdraw its consent by contacting DiDi at any time.

2.7 Third Party Services

When the Delivery Partner uses Third Party Services, DiDi will process the necessary Personal Information of the Delivery Partner (including information provided by the Delivery Partner and information recorded by the system) and share it with the third party providing the Third Party Service, including DiDi's service providers or business partners performing DiDi's business operations, so that they can provide the contracted Third Party Services to the Delivery Partner. If the Delivery Partner refuses to have such information processed, it may not be possible to use the Third Party Services through DiDi Food - Delivery Partner, but such refusal will not affect the Delivery Partner's use of the main functions of DiDi Food - Delivery Partner. The third party providing the Third Party Services will only use the Delivery Partner's information for the purposes of providing such services. Some of the Third Party Services may include, but are not limited to, collection and payment activities.

3. Device Permissions

3.1 DiDi Food - Delivery Partner may ask the Delivery Partner for certain permissions on their device. Delivery Partners will be deemed to have granted DiDi access to their device when using or accessing DiDi Food - Delivery Partner.

3.2 The Delivery Partner may cancel all or some of the permissions on his or her device to prevent DiDi from collecting the corresponding Personal Information. On different devices, the way to grant and cancel permissions may differ. For detailed information about your device and the respective operating system, we suggest contacting its developers.

4.1 Personal Information Storage Period

4.1.1 DiDi will keep the Personal Information of the Delivery Partner as long as he/she maintains a DiDi Food - Delivery Partner account and the purposes for the processing of his/her Personal Information subsist.

4.1.2 The Delivery Partner may cancel its DiDi Food - Delivery Partner account through the application directly or by contacting DiDi customer service. DiDi will retain the Delivery Partner's Personal Information if deemed necessary by applicable law or regulation, or for the purpose of protecting the Delivery Partner's personal safety and property, unless the Delivery Partner expressly requests DiDi not to do so.

4.1.3 If the Delivery Partner wishes to delete his or her Personal Information, he or she may contact DiDi's customer service area to submit the corresponding request. DiDi will delete your Personal Information, in accordance with its business practices, within a reasonable period of time as established by applicable laws and regulations.

4.2 Information Storage

The Delivery Partner accepts that, in accordance with the provisions of applicable laws and regulations, his/her Personal Information processed by DiDi will be transferred, transmitted and stored in data centers in theEUA United States of America or in any other part of the world where entities controlled by DiDi and its affiliated companies are located, as applicable. In the cases in which the data, for storage purposes, is transmitted to third parties, the Personal iInformation will be used for the purposes described in this document and in accordance with the applicable legislation.

5. Use of Personal Information

5.1 The Delivery Partner acknowledges and agrees that its Personal Information may be used in cases that are directly or reasonably related to the purposes set forth in the section "Processing of Personal Information". In particular, the Delivery Partner acknowledges and agrees:

a. That DiDi may analyze the Personal Information to provide the Delivery Partner with a more personalized and convenient service.

b. That DiDi may design, develop and promote new products and services, available for use by the Delivery Partner, based on the statistics of your Personal Information.

c. That DiDi may analyze anonymized Personal Information of the Delivery Partner and share such anonymized statistics with the public or a third party for the purpose of the operation of DiDi Food - Delivery Partner and Orders.

d. That DiDi will send the Delivery Partner information and notices by various means, which may include, among others, the verification code, necessary notifications related to the use of the products or services, news about DiDi Food - Delivery Partner services, as well as marketing activities and special promotional information, and promotional information from a third party in cooperation with DiDi Food - Delivery Partner or other content that may be of interest to the Delivery Partner if previously authorized by the Delivery Partner, as well as marketing activities and special promotional information, and promotional information from a third party in cooperation with DiDi Food - Delivery Partner or other content that may be of interest to the Delivery Partner if previously authorized by the Delivery Partner, in accordance with the information that has been provided by the Delivery Partner. If the Delivery Partner does not wish to continue receiving the aforementioned information, he/she may unsubscribe by unsubscribing.

5.2 In the event that DiDi requires to use the Delivery Partner's Personal Information beyond the scope that is directly or reasonably related to the purposes set forth in this Privacy Notice, DiDi will inform the Delivery Partner and obtain its authorization.

6. Exchange, transfer and disclosure of Personal Information

6.1 The Delivery Partner acknowledges and agrees that DiDi will maintain the confidentiality of the Delivery Partner's Personal Information in accordance with the provisions of applicable laws and regulations. DiDi will not transfer or transmit the Delivery Partner's Personal Information with other persons, except in the following cases:

i. DiDi may transfer the Delivery Partner's Personal Information to third parties located in Singapore, including, but not limited to, other companies related to DiDi.

ii. DiDi may share DiDi's Delivery Partner's Personal Information for the fulfillment of its administrative purposes and for internal reporting by DiDi's affiliated and subsidiary companies. In each case, such disclosure will be made under terms of confidentiality no less restrictive than those set forth in this Privacy Notice.

iii. DiDi may share DiDi Delivery Partner Personal Information with DiDi service providers and business partners conducting DiDi business activities to provide DiDi Services through DiDi Food - Delivery Partner to the Delivery Partner.

iv. DiDi may share Delivery Partner Personal Information to provide services in cooperation with third parties, such as DiDi service providers and commercial Delivery Partner (hereinafter referred to as "Collaborators"). To improve DiDi's Services, DiDi may share Delivery Partner Personal Information with its affiliated companies, Collaborators and their affiliates, provided that the disclosure is made under confidentiality terms no less restrictive than those set forth in this Privacy Notice.

v. DiDi may transmit or transfer the Delivery Partner's Personal Information to service providers and other partners that globally support DiDi's operation, by, for example, providing technical infrastructure services, providing criminal investigation services, analyzing how DiDi's Services are used, evaluating the effectiveness of DiDi Food - Delivery Partner, providing customer services, facilitating and processing payments or Emergency care, including its transfer to Governmental Authorities. Within the framework of the agreements entered into with DiDi, these third parties have strict confidentiality obligations in accordance with this Privacy Notice. In these cases, Personal Information will only be used for the purposes set forth in this document.

vi. When the Delivery Partner uses third party services, as described in section 2.7 (the "Third Party Services"), through DiDi Food - Delivery Partner, DiDi may share the Delivery Partner's Personal Information with whoever provides such Third Party Services, who will only use the data for the purposes described in this document, without prejudice to the possibility of the third parties obtaining the Delivery Partner's authorization for the use of the Personal Information in accordance with their own terms and conditions and privacy policies.

vii. In order to protect the legitimate rights and interests of the Delivery Partner, and/or the User, for the purpose of resolving any controversy related to DiDi's operation or for any other legitimate purpose, DiDi may disclose the Delivery Partner's Personal Information to administrative or judicial authorities in accordance with applicable laws or regulations.

viii. To the extent permitted or required by applicable laws or regulations DiDi may disclose the Delivery Partner's Personal Information necessary to protect the public interest. By accepting this Privacy Notice, the Delivery Partner acknowledges and agrees that DiDi or any of its related companies may transfer the Delivery Partner's Personal Information to the authorities and public investigative bodies indicated in the section "Purposes of Processing Personal Information", in order to agree on strategies that allow for the successful analysis, investigation and criminal prosecution of various criminal phenomena associated with mobile applications that provide services similar to DiDi's Services.

x. Other events que previously authorized by the Delivery Partner.

6.2 DiDi will not disclose the Delivery Partner's Personal Information to any third party not covered by this Privacy Notice, unless it obtains the prior express consent of the Delivery Partner. In such case, DiDi will enter into a confidentiality agreement with the third party with whom it will share the Delivery Partner's Personal Information, requiring it to take all necessary security and confidentiality measures to treat the Personal Information in accordance with applicable law.

6.3 DiDi will keep the Delivery Partner's Personal Information secure and confidential in accordance with applicable laws and regulations. DiDi will not publicly disclose the Delivery Partner's Personal Information unless the Delivery Partner has previously given its express consent or authorization, or as otherwise provided by applicable laws and regulations.

6.4 In the event of an acquisition, merger, restructuring, among other corporate changes, DiDi will require its successor to comply with this Privacy Notice. If such successor needs to change the purpose of use of Personal Information, it must obtain the prior express consent of the Delivery Partner.

7. Use of Financial Data.

DiDi will not transmit or transfer the Delivery Partner's Financial Data to any third party except to service providers that perform payment processing or any other applicable financial service, or to its affiliated companies that need to know the Delivery Partner's Financial Data for purposes of providing DiDi's Services, except for those cases expressly indicated in this Privacy Notice.

8. Delivery Partner Rights

The Delivery Partner shall have the rights enshrined in the applicable legislation and especially those presented in this Privacy Notice, which may be exercised through DiDi Food - Delivery Partner in the following ways:

8.1 Access

Delivery Partner may access your Personal Information in DiDi Food - Delivery Partner in the following ways:

a. Account

The Delivery Partner may access your Personal Information and other information you have provided through your DiDi Food - Delivery Partner account.

b. Order

The Delivery Partner will be able to access information on orders placed, order requests received, status of transactions in DiDi Food - Delivery Partner and, in general, DiDi's operation, through DiDi Food - Delivery Partner.

c. Purse

As soon as this functionality is available, the Delivery Partner can access any of its Financial Data, including payment methods and records and other respective information, through the DiDi Food - Delivery Partner wallet function.

d. Other Personal Information

Should the Delivery Partner require to exercise his/her right of access to any additional information, including his/her authorization for processing, he/she may contact DiDi's customer service team at any time.

8.2 Rectification

The Delivery Partner has the right to make corrections and updates to its Personal Information. Delivery Partner may correct or modify its Personal Information in DiDi Food - Delivery Partner by submitting a request for correction or update to DiDi's customer service team or through the following ways:

a. Account

The Delivery Partner may correct or update your Personal Information and other information you have provided through your DiDi Food - Delivery Partner account.

b. Configuration

The Delivery Partner can correct or update his password and other user configuration information through the DiDi Food - Delivery Partner configuration function.

c. Purse

The Delivery Partner may correct or modify any of its Financial Data, including payment methods and records, and other respective information, through the DiDi Food - Delivery Partner wallet function, as soon as this functionality is available.

d. Other Personal Information

Should the Delivery Partner require to exercise his rights to correct or modify any additional information, he may contact DiDi's customer service team at any time.

8.3 Opposition/Cancellation

DiDi shall guarantee the right of the Delivery Partner to revoke its consent in the following ways:

a. The Delivery Partner may revoke the authorization granted to DiDi to access its Personal Information and Sensitive Personal Data or manage its deletion through the device's configuration feature to cancel the corresponding permissions of the device (including location, address book, photo, microphone, camera, notification, etc.).

b. The Delivery Partner may also revoke part of the authorization granted to DiDi through the deletion of its Financial Data, for example, bank card information, among others.

When the Delivery Partner withdraws its consent or authorization or deletes its Personal Information, DiDi will no longer be able to provide the Delivery Partner with the services corresponding to the Personal Information a que se refiere la autorización revocada. However, when the Delivery Partner withdraws its consent or authorization, this will not retrospectively invalidate the processing of the Personal Information that DiDi has previously carried out based on the consent that the Delivery Partner has given before withdrawing it.

If the Delivery Partner is unable to directly access, rectify, cancel, or delete its Personal Information or revoke its consent, the Delivery Partner may contact the DiDi Food - Delivery Partner customer service team online or telephonically through the "customer service" function.TheDelivery Partnermay also file complaints regarding the processing of his or her Personal Information with the relevant data protection authority

9. Data Shared by the Delivery Partner

9.1 The Delivery Partner may share your location, the conditions of the Order and other information regarding DiDi Food - Delivery Partner services with third parties.

9.2 When the Delivery Partner shares your location, Order conditions or any other Personal Information with other persons or with external service providers, or uses such information in conjunction with Third Party Services or through Third Party Service links, the Delivery Partner may directly disclose your Personal Information or allow third parties to access your Personal Information. In such cases, for the purposes of the treatment carried out by the persons who own the Third Party Services, the Privacy Notice of those third parties with whom, voluntarily, the Delivery Partner agrees to share its information shall be applicable, without DiDi being responsible for the treatment of Personal Information carried out by such third parties.

9.3 DiDi recommends that, prior to agreeing to share information with third parties other than DiDi, the Delivery Partner read the Privacy Notice of the Third Party Service providers to understand the conditions under which the Delivery Partner's Personal Information will be treated. Delivery Partner shall be responsible for the consequences of providing or sharing its Personal Information with such third parties or other persons when using Third Party Services. In addition, third parties shall assume responsibility for the processing of data provided by the Delivery Partner to the extent applicable to them by law or regulation.

9.4 If the Delivery Partner makes any information public through DiDi Food - Delivery Partner, any other person who has access to the application will be able to view or access such information. As the information that is voluntarily made public by the Delivery Partner when using the DiDi Services may include Personal Information of the Delivery Partner or other persons, the Delivery Partner must take its own responsibility, and as far as possible, avoid making public its Personal Information and that of third parties.

10. Changes

10.1 In the event that any of the following changes occur in the operation of DiDi Food - Delivery Partner, DiDi will make appropriate modifications to this Privacy Notice in a timely manner:

a. Changes in DiDi Food's business functions - Delivery Partner.

b. Changes to the rules of use of the Personal Information of the Delivery Partner.

c. Changes in DiDi's contact information and channels for submitting requests and complaints.

d. Other changes that may affect the security of the Delivery Partner's Personal Data or the Delivery Partner's privacy rights.

10.2. DiDi shall not modify the conditions for the exercise of the Delivery Partner's rights under this Privacy Notice without the express consent of the Delivery Partner.

10.3. In cases where adjustments to this Privacy Notice or to the purposes of the processing of Personal Information are required, the adjustments will be informed to the Delivery Partner prior to their implementation, and the Delivery Partner may decide to revoke the authorization granted to DiDi to handle Personal Information.

10.4. Unless otherwise specified, the updated Privacy Notice shall be effective as of the date of its publication.

11. Annexes

DiDi may freely decide on annexes for each territory in which it operates by setting special rules applicable in that territory. As a general rule, this Privacy Notice will take precedence over such attachments. However, if special local rules make it necessary for the annexes to take precedence, this will be expressly established in the respective regulation.
